Welcome to Elivyn. By accessing or using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our services.
By engaging with Elivyn, visiting our website (www.elivyn.com), or purchasing any of our services, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, you must not use our services.
You must be at least 18 years old or the legal age of majority in your jurisdiction to use our services.
By agreeing to these Terms, you represent and warrant that you meet these requirements. If you are entering into this Agreement on behalf of a company or other legal entity, you further represent that you have the authority to bind such entity to these Terms.
Elivyn offers the following professional services to real estate professionals and agencies:
Content Creation – social media posts, property marketing visuals, branded digital assets, and campaign management.
Virtual Assistance – administrative support including scheduling, CRM management, lead follow-ups, inbox management, and client communication.
Website Design & Development – realtor-focused websites with IDX integration, lead capture tools, SEO setup, and custom branding.
All-in-One Packages – bundled service plans that combine features from the above categories for a complete marketing and operations solution.
The specific scope, deliverables, and timelines for each service are outlined on our website or in your individual service agreement.
All payments must be made in full upfront unless otherwise agreed in writing.
Invoices are issued directly by Elivyn.
Services will not begin until payment has been confirmed.
Subscription services (if applicable) are billed on a recurring basis. Clients are responsible for canceling subscriptions before the renewal date to avoid further charges.
All fees are non-refundable unless explicitly stated in writing.
Clients must provide all necessary information, brand assets, content materials, and account access reasonably required for Elivyn to deliver services.
Any delay in providing requested materials, feedback, or approvals may result in corresponding delays in service delivery. Elivyn shall not be held responsible for such delays.
Clients are responsible for reviewing and approving all content, designs, and deliverables in a timely manner. Failure to provide feedback within the agreed timeline will be deemed as approval, and Elivyn may proceed accordingly.
Clients acknowledge that the quality and timeliness of the final deliverables depend on their active participation and cooperation.
All content, graphics, and materials created by Elivyn remain the property of Elivyn until full payment is received.
Upon full payment, ownership of custom-created deliverables (excluding third-party assets, licensed software, stock images, or proprietary tools) is transferred to the client for their business use.
Any pre-existing intellectual property, frameworks, or templates used by Elivyn in the creation of deliverables remain the property of Elivyn and are licensed to the client for use as part of the final deliverable.
If Elivyn builds or integrates a Content Management System (CMS) as part of services, ownership of the CMS platform itself shall remain with the original provider or Elivyn, as applicable. The client receives a license to use the CMS as part of the agreed deliverable but does not acquire ownership of the platform.
Elivyn retains the right to use completed projects in portfolios, case studies, and marketing materials unless explicitly prohibited by the client in writing.
Clients agree not to use Elivyn’s services or deliverables for unlawful, misleading, or harmful purposes. Elivyn is not responsible for any misuse of content or websites created on behalf of clients.
Elivyn is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services.
Elivyn does not guarantee specific results such as sales volume, lead quantity, or conversion rates. Marketing outcomes vary based on multiple external factors outside of our control.
Website uptime and performance are dependent on hosting providers and third-party integrations. Elivyn cannot be held responsible for downtime or technical issues beyond our control.
Mutual Termination: Either party may terminate this agreement by providing written notice.
Client-Initiated Termination: If the client terminates services before project completion, all fees paid are non-refundable. Elivyn reserves the right to invoice the client for any work performed, resources allocated, or expenses incurred up to the date of termination.
Elivyn-Initiated Termination: Elivyn may suspend or terminate services immediately, without refund, if the client:
engages in abusive, threatening, or inappropriate behavior,
violates these Terms or any applicable laws, or
fails to make timely payments.
Effect of Termination: Upon termination, all outstanding fees shall become immediately due and payable. Elivyn shall have no further obligation to provide services, access, or deliverables after the termination date.
These Terms and Conditions shall be governed by and construed under the laws of the State of Wyoming and the United States, without regard to conflict of law principles.
Elivyn reserves the right to update or modify these Terms and Conditions at any time. Continued use of our services after updates indicates acceptance of the revised Terms.
